Our practice represents clients charged with both state and federal misdemeanors and felonies. Some types of cases we represent include those involving: 

DUI and Vehicular Homicide

One important type of criminal charge in California is DUI and, in unfortunate circumstances, DUI involving death. Recall that anyone who drives while under the influence of drugs or alcohol or with a blood alcohol concentration (BAC) of .08% may be charged with DUI in California. The BAC threshold is lowered for commercial drivers to .04% and for underage drivers (under 21 years old) to .01%.

Upon conviction, an individual could face a range of penalties depending on how many prior convictions they have (California DUI convictions count as priors for 10 years):

  • 1st offense – up to 6 months in jail; $390-$1,000 in fines; 6 months of license suspension; up to 6 months or 12 months of ignition interlock device (IID) use with a restricted license
  • 2nd offense – minimum of 96 hours in jail up to 1 year in jail; $390-$1,000 in fines; 2 years of license suspension; 1 year of IID use
  • 3rd offense – at least 120 days in jail and up to 1 year in jail; $1,800 in fines; 3 years of license suspension; 2 years of IID use

Sex Crimes in California

California law has several legal statutes in place addressing sex crimes in the state, such as rape and child molestation. For instance, California Penal Code 261 PC defines rape as non-consensual sexual intercourse with another person by means of force, threats of force, or fraud. Rape is a felony in California, and the crime is typically punishable by up to 8 years in state prison and/or felony probation. Under aggravating circumstances, a person could also face an additional 3-13 years in prison.

Most sex crimes like rape and certain child molestation will require convicted individuals to register as sex offenders for life. This could have detrimental consequences to your ability to re-integrate into society, but our attorneys at Thompson • Garcia Law have experience helping clients seek deregistration and avoid further penalties like deportation, as sex offenses are crimes involving moral turpitude (CIMT) that could penalize non-citizen defendants’ chances at citizenship.
